Indiana’s expungement law includes the following general provisions for those with no prior convictions or criminal charges. If you have:
Been arrested but not convicted, OR been convicted but had a successful appeal. You are eligible to apply 30 days to one year depending on the specifics of your case.
Been convicted of a misdemeanor or Class D felony reduced to a misdemeanor. You are eligible to apply no earlier than five years.
Been convicted of a non-violent felony. You are eligible to apply eight years after the conviction
Been convicted of any other type of felony. You are eligible to apply after 10 years of the conviction.
